Dale Earnhardt Jr. stands with half-brother Kerry and against stepmother Teresa in the latest chapter of their family feud.

At stake: the right to use the Earnhardt name in ventures not involving the estate of their late father. Teresa Earnhardt is fighting in court to stop Kerry from using the name of NASCAR legend Dale Earnhardt.

Family members have spent years squabbling with Teresa, who is Dale’s widow. Teresa married Dale in 1982, was his third wife and now claims ownership of his estate and exclusive use of his name.

Kerry is the son of Dale and his first wife Latane. Junior is the son of Dale and his second wife Brenda.

Having lost a U.S. Patent and Trademark Office ruling, Teresa is appealing a decision to allow Kerry and his wife to use Earnhardt in an arrangement with a homebuilder and for a home goods line. Her argument: Kerry’s use of the name could create confusion with the estate of her late husband.

Junior had been quiet about the ongoing dispute until this week, when The Charlotte Observer got him on record.

“Obviously, I’m in support of my brother,” Junior said.

Considering his conflict with Teresa, which ended with him leaving Dale Earnhardt Inc. to join Hendrick Motorsports in 2007, that comes as no surprise.

“This is a business venture that he’s put a lot of effort and heart and soul in that I think he deserves,” Junior said of Kerry. “So in this particular case, I side with my brother and his belief to be able to use the name as is — without any alterations or changes.”

Dale Earnhardt died in a crash at the end of the 2001 Daytona 500. Kerry participated in NASCAR races. Junior has been NASCAR’s most popular driver the past 13 years. He is preparing for Sunday’s Coca-Cola 600 at Charlotte, a race he has never won.
